New Delhi: Chief Justice of India NV Ramana on Tuesday said a judge cannot defend himself from “motivated attacks” against him while he is on the bench, while a retired judge can do so when required.
The Chief Justice, who retired on Tuesday after serving for more than three years in the Supreme Court, replaced Justice R. Said this at the farewell program of Subhash Reddy.
Although the CJI did not give any examples of “motivated attacks”, he himself was the target of Andhra Pradesh Chief Minister YS Jagan Mohan Reddy. In a digital farewell program organized by the Supreme Court Bar Association for Justice Reddy, Justice Ramana said that retirement is exactly like ‘getting back freedom’, especially for a judge, as he is then freed from all restrictions which are imposed on the post. “While he is on the bench, no judge can defend himself against motivated attacks. Whereas a retired judge is free to defend himself when needed. I am sure Reddy bhai will make the best use of the new freedom.
Justice Reddy was elevated as a judge of the Supreme Court on 2 November 2018. He was the first judge from Telangana to be appointed to the Supreme Court. After his retirement, the number of judges in the apex court will come down to 32, while the total sanctioned strength is 34.
Earlier in the afternoon, the CJI, who sat for a ceremonial hearing, lauded his contribution, saying he upheld and protected the freedom of the people and displayed compassion and consciousness towards social realities.
The CJI, who sat for the ceremonial hearing in the afternoon along with Justice Reddy, Justice Surya Kant and Justice Hima Kohli, had appreciated him (Justice Reddy).
The CJI said, ‘During being together for 30 years, I got his strong support and friendliness. I give my best wishes. Justice Reddy is the first judge of the Supreme Court from the Telangana state after its formation.
Justice Ramana said Justice Reddy, like him, hails from a farming family and achieved many achievements in his journey as a legal professional.
“During his tenure as a judge in various High Courts for 20 years, he always upheld and protected the liberty of the people,” the CJI said. He resolved many sensitive questions of law and wrote more than 100 judgments during his tenure as a Supreme Court judge. I also shared my bench with him and benefited from his thoughts.
He said that Justice Reddy is known for his compassion and consciousness towards social realities.
He said that the outgoing judges will be remembered for their dedication towards the administrative work of the apex court. The CJI said, ‘His expertise is in constitutional law’.
On this occasion, Attorney General KK Venugopal, Solicitor General Tushar Mehta and Supreme Court Bar Association President Vikas Singh among others also mentioned the contribution of Justice Reddy.
