The senior judge of the High Court Bench hearing the case said that the police prepared two memos of Section-27 against two people in the same case. One of the accused said that the woman/girl who had been murdered was with him. The police then presented a challan against him. Whereas the second accused said that I raped the victim, after killing her, threw the body in the drain. The police did not collect any evidence against him, why and how is this possible? This is your conduct (of the police station who filed the chargesheet). During the hearing of the case, the High Court Bench also took a jibe at the Additional SP present in the dock. The High Court said that you are entitled to compulsory retirement with penalty.
On hearing the reprimands of the High Court, the Additional SP present sweated. The High Court did not stop here. Justice Rohit Arya, who caught the act of the police in the case, further said, “This act of yours is a black stain for the police department. You should be sacked then. Such a person does not have the right to be in the police department. The High Court further said that, “It is the discretion of the police, in whichever case it wants to present the challan (chargesheet), and in which case it does not want, then it should not present the challan at all. Not presenting the charge sheet against the person who himself has confessed to the crime of raping and killing the dead body is an unforgivable offense.
Court expressed strong displeasure
The court also said that after this you (Additional SP present in the dock) are also justifying the wrong thing by coming here. The whole staff is coming and sitting here (High Court). To justify something outright wrong. These are your actions. I am not bonafide off duty in this. I would call it actions. This is your act. That too of a police officer who himself was the chief of the Special Investigation Team (SIT). When the SIT headed by the Additional SP is doing this in the case of murder and rape, then it is clear what the police station would have done? Wouldn’t have done anything.”
